			<content:encoded><![CDATA[<p>Current Incubus DJ Chris Kilmore sought a restraining order against the former DJ for Incubus Gavin Koppell this week. Kilmore says that Koppell is still bitter that he was replaced in the band.</p>
<p>According to court documents filed last week in L.A. County Superior Court, Kilmore says Koppell threatened to kill him last month over something that happened in 2003. Kilmore obtained a restraining order against Koppel back in 2003 after Koppell allegedly spit in Kilmore&#8217;s face.</p>
<p>Kilmore replaced Koppell in the band in 1998.</p>
<p>Kilmore now alleges that Koppell approached him in a store and said, &#8220;You will get killed if you don&#8217;t lift that order &#8230; people get killed in the street for that.&#8221; Kilmore also claims Koppell, &#8220;asked me to fight him right there and raised his fists to me.&#8221;</p>
<p>According to the restraining order, Koppell has been ordered to stay at least 100 yards from Kilmore and his girlfriend.</p>

Unfortunately for Joe Jackson, the subpoenas were issued in the probate case and appear to be irrelevant.</p>
<p>Michael Jackson&#8217;s estate lawyers clearly think so, according to <a href="http://tmz.vo.llnwd.net/o28/newsdesk/tmz_documents/1231_jackson_ucla_wm.pdf" target="_blank">a letter sent by them to Joe Jackson&#8217;s attorney last week</a>. The subpoenas seek the release of all of Michael Jackson&#8217;s including medical records, autopsy reports, autopsy photos, medications and prognosis assessments.</p>
<p>Joe Jackson told gossip website TMZ that the entire Jackson family supports the subpoenas and believes that the medical records will reveal that Michael Jackson&#8217;s death was the result of foul play. Regardless of whether the Jackson family &#8220;supports&#8221; the subpoenas, the law still has to allow them.</p>
<p>Joe Jackson is a party to the probate estate case as a result of his Petition for Family Allowance &#8211; i.e., he wants to be supported by Michael&#8217;s estate. Michael&#8217;s estate attorneys basically represent and protect Michael (and his money). If Michael&#8217;s children (or the guardians and attorneys on their behalf) choose to file a wrongful death claim against anyone, that is likely the only civil forum in which Michael&#8217;s medical records will be properly subpoenaed to prove cause of death.</p>
<p>What drugs were present in Michael&#8217;s system is, in my opinion, completely irrelevant to whether Joe Jackson should be granted support payments from Michael&#8217;s estate. </p>

If you recall, his family started fighting immediately and he wasn&#8217;t even buried for two months because of their bickering and legal maneuvering. About six months later, the family started making claims that millions of dollars were missing from Brown&#8217;s estate. They claimed that trustees had mismanaged funds.</p>
<p>In 2008, Brown&#8217;s older children and others went to court, questioning whether his marriage in 2001 to Tomi Rae Hynie Brown was even legal and whether his son with her was really legitimate. These two issues would have huge inheritance implications.</p>
<p>The estate has finally been settled this week. On Tuesday, a South Carolina judge approved a settlement giving nearly half of Brown&#8217;s assets to a charitable trust. A quarter was given to Tomi and their young son, and the rest to Brown&#8217;s six adult children.</p>
<p>Unlike most probate estates, this wasn&#8217;t just a fight over existing assets. Brown&#8217;s estate, due to his fame and music, will continue to earn income in the future. And that money will be divided going forward.</p>

			<content:encoded><![CDATA[<p>Britney Spears&#8217; former bodyguard Kerry Vine filed a lawsuit against the pop star this week. In the suit, Vine claims he sustained physical injuries while working at her former home at the Summit in Beverly Hills in March 2008. He also sued the security company with which Spears contracted (Vine&#8217;s actual, legal employer).</p>
<p>&#8220;Advanced Security Concepts negligently operated their business thereby causing injuries to [Vine] who worked for [Spears] at the time,&#8221; Vine&#8217;s attorney, Charles Swain, wrote in the complaint. &#8220;[Spears] breached that duty of care to the plaintiff by failing to ensure that he could safely perform duties that Advanced Security Concepts ordered him to perform.&#8221;</p>
<p>Vine is suing Spears for personal injury, battery and negligence for which he claims he has suffered lost wages, medical and hospital costs, and loss of personal property and earning capacity. I&#8217;m not sure exactly what happened &#8211; but it seems to be a pretty run-of-the-mill personal injury claim that will be handled by insurance defense attorneys. Any judgment or settlement will most likely be paid out of insurance funds.</p>
<p>The next hearing is scheduled for Sept. 2.</p>

<p>West&#8217;s road manager, Don Crawley, was also charged and also pleaded not guilty through his attorney, Shawn Chapman Holley.</p>
<p>Eight months ago, the two were arrested for the altercation while attempting to catch a flight to Honolulu. Video of the incident showed both men wrestling a camera away from a photographer, with each smashing parts of it into the ground.</p>
<p>Crawley also allegedly smashed a second photographer&#8217;s camera.</p>

<p>Monroe jumped on stage during a Snoop Dogg concert and then got beat up by security. He claimed he was &#8220;left for dead&#8221; and that Snoop also got a hit in.  He also alleged that Snoop Dogg encouraged fans to join him on-stage.</p>
<p>The jury watched video footage of the incident and cleared Snoop. They did feel someone was at fault though and found the label liable. Say that 10 times fast &#8211; label liable, label liable&#8230;.</p>

<p>In her lawsuit filed Tuesday in U.S. District Court in Washington, Bain says Jackson agreed to pay her 10 percent of any agreements that she handled. She alleges that Jackson didn&#8217;t pay her for negotiating the release of a CD to commemorate the 25th anniversary of his &#8220;Thriller&#8221; album, refinancing his loan to keep the Beatles&#8217; song catalog, and negotiations that led to an upcoming sold-out concert series in London.</p>
