Graziano, a former U.S. Marine, was Nick’s passenger at the time of the crash. His family has sued Nick Bollea and both parents for negligence. The trial is currently scheduled for September. The Graziano family’s attorney has indicated that it is unlikely that either Nick or Hulk will settle before trial.

At a hearing Tuesday, Judge Michael Tynan ordered Redmond, 24, into a 30-day jail rehab facility pending a Feb. 2 progress report.

“It seems to me you haven’t got a clue as to what recovery means,” Judge Tynan lectured. “It’s a lifetime commitment. It’s grinding, hard, painful work.”

Andrew filed the suit last year, claiming that Duke and its varsity golf coach breached a contract with him when he was dismissed from the golf team in early 2008.

The university and the coach O.D. Vincent responded by saying that Andrew was dismissed for behavior like assaulting a teammate, defying coaches, and violating “both the rules and the spirit of the game of golf.”

In an opinion issued earlier this week, Magistrate Judge Wallace W. Dixon sided with Duke in its motion for judgment on the pleadings against Giuliani (that means that Duke didn’t think the lawsuit had even enough merit to go to trial and to a jury). A copy of Dixon’s opinion, which will now most likely be adopted by a U.S. District Court judge and bring the case to an end, can be found at The Smoking Gun. It is peppered with golf references and even a Caddyshack quote. Good stuff.

Andrew skipped the graduation ceremony at Duke last week. Shocker.

He was ordered to a drug rehab program at Wayside Honor Ranch. It is in-custody treatment. If he fails to complete rehab successfully, O’Neal will face up to four years in prison.

Prosecutor Tony Estradas spoke directly to O’Neal in court, saying: “Redmond O’Neal, welcome to drug court. This is an opportunity for you to change your life. If you successfully complete the program, any outstanding cases, past convictions, probation, will be dismissed and cleared from your record.”

“The program will take at least one year. During that time you will work with counselors. You will submit to drug tests, one-on-one counseling, a 12-step program. You will come to court frequently. People will help you. As part of this program, you must have a job, or schooling to help you get a job.”

“We don’t want you to be in jail, we want you to beat your addiction. If you fail to comply with your counselors, you could be sanctioned with writing an essay, community service, or jail.”

O’Neal, son of actors Ryan O’Neal and Farrah Fawcett, was then ordered back to court on May 28 for a progress report.

Okay, Perez. Twice in one day?! Come on.

Perez Hilton is under the false impression that an initial “not guilty” plea is some sort of indication that a criminal defendant wants people to believe he is innocent. And, as we mentioned here earlier, that’s just not the case. It makes for a dramatic blog post, sure. But it’s inaccurate and untruthful.

This afternoon, Perez reported that Redmond O’Neal pleaded not guilty to his newest drug charges. Perez says: “O’Neal must be suffering delusion or bitchassness! The former rehaber just pleaded Not Guilty on Wednesday in a Los Angeles County courthouse to his felony drug charges. Let’s guess, the drugs found on him, weren’t his. They were a friend’s?”

Dude. Calm down. Like we mentioned before, a “not guilty” plea at this point just means that he’s not ready to plead guilty. He can certainly go to trial if he wants to and if it’s appropriate. But even if he eventually pleads guilty (which he probably will do), he’s gonna start off with a “not guilty” plea. It just allows everyone involved more time to dig into the case and decide how best to resolve it.

Mountain out of less than a mole hill. Relax, Perez.
